Thefaut v Johnston [2017] EWHC 497 (QB) (14 March 2017)

C suffered from low back pain an leg weakness. She consulted D and was assessed. On 17 May 2012 she underwent left sided L4/L5 discectomy. She experienced neurological symptoms after surgery.

C complained: (1) informed consent, and (2) negligence in the performance of the discectomy.

The court found: (a) the claim succeeds against D upon the basis of the issue relating to informed consent; (b) the claim does not succeed upon the basis of negligence in relation to the performance of the surgery.
