Hosseini v Central Manchester University & Anor [2016] EWHC 974 (QB) (04 May 2016)

Trial on liability and quantum of the claim by C at D’s Hospital on 30 January 2006 when she was 12. C had a pre-existing condition of cerebral palsy and had developed a progressive curvature of the lumbar spine (neuromuscular scoliosis). A correctional operation was performed on her. The scoliosis was corrected but she sustained damage to her cauda equina with consequent and permanent lower paralysis. Damage to the spinal cord is a known risk of such surgery.

There were three groups allegations of negligence relating to the surgery. The damage probably occurred post-operatively.

The claim did not succeed.
