Cooper v Royal Berks NHS FT [13 March 2015] Hamed [16 February 2015]

Vaginal delivery after caesarean section – uterine rupture, baby died – some days later mother found in asystolic state and resuscitated but had suffered brain damage. The issue was whether the primary underlying pathology was cerebral venous thrombosis (negligent – failure to provide heparin) or post partum eclampsia (non negligent). The evidence was complex and conflicting. The court found for the claimant.
