Alexander v HCA International Ltd & Anor [2026] EWHC 1284 (KB) (29 May 2026)

This is the trial of C’s claim for damages for clinical negligence arising out of an endoscopic retrograde cholangiopancreatography procedure (ERCP) performed on 16 July 2019 by D2. C was a private patient at the Hospital, which is owned and operated by D1. [1]

C was born on 27 February 1968. [20]

On 16 July 2019, C underwent an ERCP at the Hospital, performed by D2. The ERCP revealed an 8mm stone in the distal common bile duct, which was removed. [26]

On 17 July 2019 at 02:29, C attended emergency department severe abdominal pain. Severe acute necrotising post ERCP pancreatitis was diagnosed. [45]

[Issues appear to be:

was diclofenac administered to C?

if not. was this a breach of duty?

was this omission causative of post ERCP pancreatitis?]

i) There be judgment for C against D2 in the sum of £550,000.

ii) The claim against D1 be dismissed. [326]

As a result of Diclofenac not being administered, C suffered life-threatening severe acute necrotising post ERCP pancreatitis. After the ERCP, C was in hospital for nearly four months, during which time he underwent multiple operations. [327]
